الشروط والأحكام المنظمة لاستخدام منصة مشوارنا

هذه الشروط توضح القواعد الأساسية لاستخدام تطبيق مشوارنا، سواء في الرحلات العادية أو في تنسيق المستخدمين مع بعضهم لطلب رحلة خارجية بشكل جماعي.

1. نطاق الخدمة وطبيعة المنصة

تطبيق مشوارنا هو منصة تقنية تساعد المستخدمين على نشر الرحلات، الحجز عليها، أو التنسيق مع بعضهم للتجمع وطلب رحلة خارجية بشكل جماعي. التطبيق ليس شركة نقل ولا يملك أو يشغّل السيارات.

دور مشوارنا يقتصر على تسهيل التنسيق داخل المنصة فقط، أما الاتفاق الفعلي بين المستخدمين واستخدام أي رحلة فيتم على مسؤوليتهم الشخصية.

أي تقييم أو شارة توثيق داخل التطبيق هي وسيلة مساعدة فقط، وليست ضماناً كاملاً للسلوك أو الأمان.

2. الحسابات والأهلية والتوثيق

  • يجب ألا يقل عمر المستخدم عن 18 سنة، وأن تكون لديه الأهلية القانونية الكاملة لاستخدام التطبيق.
  • يلتزم المستخدم بتقديم بيانات صحيحة ومحدثة، وعدم إنشاء حسابات وهمية أو انتحال صفة أي شخص أو جهة.
  • يجوز التسجيل بالبريد الإلكتروني وكلمة المرور أو عبر مزودي الدخول المعتمدين مثل Google وApple وفق ما يتيحه التطبيق.
  • يجوز لمشوارنا طلب مستندات للتوثيق أو تعليق أي حساب عند وجود بيانات غير صحيحة أو إساءة استخدام.

3. شروط استخدام الراكب

  • يستخدم الراكب التطبيق للبحث عن رحلة مناسبة وحجزها من خلال الخيارات المتاحة داخل المنصة.
  • يجوز للمستخدمين الاتفاق والتجمع معاً داخل التطبيق لطلب رحلة خارجية بشكل جماعي، ويكون هذا الاتفاق واختيار المشاركين والتعامل بينهم على مسؤوليتهم الشخصية.
  • يحظر على الراكب تقديم معلومات مضللة أو إساءة استخدام الحجز أو الشات أو التسبب في إزعاج لباقي المستخدمين.

4. شروط استخدام السائق

  • يلتزم السائق بامتلاك رخصة قيادة سارية، ورخصة مركبة سارية، وأي تأمين أو مستندات يفرضها القانون المعمول به.
  • السائق مسؤول عن سلامة السيارة والالتزام بقواعد المرور وصحة بيانات الرحلة التي ينشرها.
  • يُقر السائق بأنه يستخدم المنصة بصفته مستقلاً، ولا تنشأ بينه وبين مشوارنا أي علاقة عمل أو وكالة أو شراكة.
  • السائق هو الذي يحدد سعر الكرسي الذي يراه مناسباً داخل التطبيق.
  • يحظر القيادة المتهورة أو إساءة استخدام التطبيق أو بيانات المستخدمين.

5. الرحلات والحجوزات والتنسيق

  • تتيح المنصة نشر الرحلات العادية، الحجز عليها، التنسيق عبر الشات، وإدارة بعض تفاصيل الرحلة داخل التطبيق.
  • كما قد تتيح للمستخدمين التجمع معاً وطلب رحلة خارجية بشكل جماعي، ومشوارنا هنا يقتصر دوره على التسهيل والتنظيم داخل التطبيق فقط.
  • أي اتفاق بين المستخدمين بخصوص الرحلة أو التجمع أو التوقيت أو مكان التحرك يكون بينهم وعلى مسؤوليتهم الشخصية.

6. الرسوم والتسويات

  • الغرض من الرحلات داخل التطبيق هو مشاركة تكاليف الرحلة بين المستخدمين، وليس تقديم خدمة نقل من مشوارنا.
  • السائق هو الذي يحدد سعر الكرسي الذي يراه مناسباً داخل التطبيق.
  • قد يوضح التطبيق عمولة أو رسوم خدمة أو رصيداً داخلياً خاصاً بالسائق يُستخدم في تسوية رسوم المنصة.
  • أي التزامات مالية أو قانونية تتعلق باستخدام الرحلات أو المبالغ بين المستخدمين تبقى على مسؤولية أصحابها.

7. السلوك المحظور والبلاغات والإنذارات

  • يحظر استخدام التطبيق في الاحتيال أو التحرش أو انتحال الهوية أو إساءة استخدام الحجز أو الشات أو بيانات الآخرين.
  • يجوز للمستخدمين تقديم تقييمات وبلاغات، ويجوز لمشوارنا اتخاذ إجراءات مثل التنبيه أو الإنذار أو التعليق أو الحظر عند الحاجة.

8. إخلاء المسؤولية وحدودها

يتم توفير التطبيق كمنصة تقنية وسيطة للتنسيق بين المستخدمين فقط.

  • لا يضمن مشوارنا أو مطورو التطبيق توافر الخدمة بشكل دائم، ولا سلوك المستخدمين أو جودة السيارات أو الالتزام بالمواعيد أو نجاح أي اتفاق بين المستخدمين.
  • استخدام الرحلات أو ميزة التجمع وطلب رحلة خارجية يتم على مسؤولية المستخدمين المشاركين فيها بالكامل.
  • لا يتحمل مشوارنا أو القائمون عليه أي مسؤولية قانونية أو مالية أو تعويضية عن الحوادث أو الأضرار أو الخلافات الناتجة عن استخدام المنصة، وذلك في الحدود التي يجيزها القانون.
  • كما لا يتحمل مشوارنا المسؤولية عن أي انقطاع أو تأخير أو خلل في الخدمة بسبب أعطال فنية أو تحديثات أو ظروف خارجة عن الإرادة.
  • في حال وجود بلاغ أو نزاع، قد يقتصر دور مشوارنا على تقديم الدعم الممكن مثل توفير بيانات الرحلة المتاحة لتمكين المتضرر من اتخاذ الإجراء المناسب ضد الطرف المسؤول، ويُعد ذلك كامل مسؤولية مشوارنا في هذا الشأن.

1. Scope of Service and Nature of the Platform

Meshwarna is a technology platform that helps users publish rides, book rides, and coordinate with each other, including shared requests for an external ride as a group. The App is not a transportation company and does not own or operate vehicles.

Meshwarna's role is limited to facilitating coordination inside the platform only. Any actual agreement or ride usage between users remains their own responsibility.

Verification badges and ratings are helpful indicators only and are not full guarantees of conduct or safety.

2. Accounts, Eligibility, and Verification

  • You must be at least 18 years old and legally capable of using the service.
  • You must provide accurate, current information and must not impersonate any person or create misleading accounts.
  • Registration may be completed through email and password or supported sign-in providers such as Google or Apple.
  • Meshwarna may request verification documents and may suspend or restrict an account if the information is inaccurate or misuse is suspected.

3. Passenger Terms

  • Passengers may use the App to search for suitable rides and book them through the available platform features.
  • Users may also coordinate together inside the App and submit a shared request for an external ride as a group, and this arrangement remains their own responsibility.
  • Passengers must not misuse bookings, chat, or other users' information.

4. Driver Terms

  • Drivers must hold valid legal documents and are responsible for the vehicle, ride details, and compliance with traffic rules.
  • The driver uses the platform as an independent party, and no employment, agency, or partnership relationship is created with Meshwarna.
  • The driver sets the seat price shown in the App.
  • Reckless driving or misuse of the App or user data is strictly prohibited.

5. Trips, Bookings, and Coordination

  • The platform allows ordinary ride publishing and booking, trip chat, and related coordination features.
  • It may also allow users to gather together and request an external ride as a group, with Meshwarna only facilitating this inside the App.
  • Any agreement between users about timing, pickup, participation, or conduct remains their own responsibility.

6. Fees and Settlements

  • The purpose of rides on the App is to help users share trip costs, not to provide a transportation service by Meshwarna.
  • The driver sets the seat price in the App.
  • Meshwarna may apply service fees, commissions, or a driver-only internal balance used to settle platform fees.
  • Financial or legal responsibilities related to user arrangements remain with the users involved.

7. Prohibited Conduct, Reports, and Strikes

  • You may not use the App for fraud, harassment, impersonation, misuse of bookings, or misuse of chat or user information.
  • Users may submit ratings and reports, and Meshwarna may issue warnings, restrictions, suspension, or bans when needed.

8. Disclaimer and Limitation of Liability

The App is provided only as an intermediary technical platform for coordination between users.

  • Meshwarna and the App developers do not guarantee continuous service availability, user conduct, vehicle quality, punctuality, or the success of any agreement between users.
  • Use of rides or group external ride requests remains entirely the responsibility of the participating users.
  • Meshwarna and its operators are not legally or financially liable for accidents, damages, or disputes arising from the use of the platform, to the extent permitted by law.
  • Meshwarna is also not responsible for any interruption, delay, or service failure caused by technical issues, updates, or circumstances beyond its control.
  • In the event of a report or dispute, Meshwarna's role may be limited to providing available trip data or similar support to help the affected user take action against the responsible party, and this shall constitute Meshwarna's full responsibility in that regard.
